I am a Freelance Illustrator and Character Designer.

Terms of Service

ALL CLIENTS must abide by these terms.
Please read this entirely and carefully.

If you are unwilling to agree to my Terms of Service nor understand my process, this may result in dropping the Commission, the refusal to continue doing business with the Client, and, depending on the severity, the potential BLACKLISTING of the Client.

GENERAL TERMS

✦ DO NOT CLAIM MY WORK AS YOUR OWN NOR LEAVE MY WORK UNCREDITED.

Please credit as ‘Crysteria’ for all Commissioned Works actively being used.
On Twitter, please credit or tag me as @XCrysteriaX.
For ‘Other Sites’, please link to my Twitter or Website.

✦ Redistributing/Reselling/Reproducing of my Commissioned Works is PROHIBITED.✦ Modifying/Editing/Tracing of my Commissioned Works is PROHIBITED.✦ DO NOT use my Commissioned Works for AI Machine Learning/Sampling/Training and be used on AI Generator Services.✦ Clients are NOT allowed to use, showcase, or profit off my Commissioned Works for any NFT/Crypto/Blockchain Businesses or Technologies.✦ ALL CLIENTS who have received Commissioned Work before this TOS has gone into effect are STILL BOUND to its contents.

PERSONAL/COMMERCIAL USE

✦ ALL COMMISSIONED WORKS ARE FOR PERSONAL USE ONLY.

PERSONAL USAGE includes:

✦ DO NOT USE IT FOR COMMERCIAL USE.✦ If ordering a Commission for Commercial Use, the Client must pay either the Promotional or Redistribution License, depending on the intent/purpose of the Commissioned Work.✦ For obtaining the Promotional License, the Commissioned Work will have a 2x fee applied.

PROMOTIONAL USAGE includes:

✦ For obtaining the Redistribution License, the Commissioned Work will have a 3x fee applied.

REDISTRIBUTION USAGE includes:

ADOPTABLE DESIGNS

✦ In the case of an Adoptable Design, I WILL NOT:

REUSE/RESELL the rights to the design once ownership is transferred to the CLIENT.

✦ Adoptable Designs (Design/Art/ETC.) used for COMMERCIAL USE is PROHIBITED.

ONLY PERSONAL USE IS ALLOWED.

✦ If the Client wishes to use for COMMERCIAL USE, a +$250 USD Fee will be applied.

COMMERCIAL USAGE includes:

✦ THE CLIENT IS PROHIBITED TO ALTER THE ORIGINAL DESIGN.✦ RESELLING of my Adoptable Designs is PROHIBITED.

Under Special Circumstances, the Client is REQUIRED to contact me for my consent to RESELL.
If given my consent, the Client must resell for 50% LESS than what was paid to me.

✦ IF RESOLD WITHOUT MY CONSENT, the Client will be BLACKLISTED.✦ In the case of Adoptable Design Auctions, Clients are NOT allowed to retract their bid.

The first instance of a problematic transaction will receive a ‘Verbal Warning’.
The second instance, the Client will be BLACKLISTED and refused the opportunity for future bids.
CLIENTS SHOULD ONLY BID IF THEY CAN PAY FOR THE BIDDING.

✦ REFUNDS ARE PROHIBITED FOR ADOPTABLE DESIGNS.

ARTIST RIGHTS

✦ The rights of ALL COMMISSIONED WORKS, belong to me, Crysteria.

Therefore, I reserve FULL RIGHTS to:
Showcase Commissioned Works on my Social Media (Twitter)
Self-Promotion (Art Portfolio/Commission Samples/ETC.)

✦ I RESERVE THE RIGHT TO SIGN AND/OR WATERMARK MY OWN WORK.

ALL CLIENTS ARE PROHIBITED TO REMOVE MY SIGNATURE.
Depending on the intent/purpose of the Commissioned Work and asked upon request:
A Non-Signature Version of the Commissioned Work will be sent to the Client.

✦ Unless the Commissioned Work was one of my own designs, I WILL NOT:

CLAIM the rights to a Character Design.
REUSE/RESELL Commissioned Works for Personal or Commercial Projects unless agreed upon.

✦ I reserve the right to decline a Reserved/Ongoing Commission Request for any reason.

Whether the request is questionable or the behavior and/or credibility of the Client is intolerable.

✦ I reserve the right to refund the Client the FULL AMOUNT paid if I no longer wish to work on the Commission for any reason.

NDA/PRIVACY REQUEST

✦ Request to have the Commissioned Work be PRIVATE must be stated prior to payment.✦ For the Privacy Request, I AM PROHIBITED:

To post the Completed Work until I am given permission by the Client.
To share any WIPs on any Social Media Platform.
To stream the process of the Commission anywhere.

✦ For obtaining the Privacy Request, the Commissioned Work will have a $200 USD applied.

For returning Clients, the fee will be ½ the price ($100 USD).

ORDER PROCESS

✦ The Client is expected to fill out the Commission Ordering Form when my Slots are OPEN.

Please make note of the required details and thoroughly fill in the form.
Describe the Commission Request as concisely as possible and provide thorough ‘Image References’.

✦ If the Client has ANY INQUIRIES, please contact me via Private Messaging or Email.

All messages must be in ENGLISH.
Please use DEEPL Translator for Korean/Japanese messages.
Any inquiries will receive a response within 3-7 Business Days.

✦ Any harassment in an attempt to bargain for a Commission/Slot is NOT TOLERATED.

This includes ‘Inappropriately Worded Comments’ on my Profile, as well as Private Messages.
I reserve the right to place anyone on the BLACKLIST OVER HARASSMENT.

✦ When the Slot is CONFIRMED, the Client will receive a notice via Private Messaging or Email.

Before the payment transaction, details will be discussed if I inquire more information.

✦ If the Client’s Character(s) of Request has a Complex Design, I have the right to charge a Detail Fee.

This Fee will be always stated before the Payment Transaction.
The Client holds the right to amend changes before the Payment Transaction is complete.
Either the Client agrees to details being simplified or changes the Character(s) of Request.

PAYMENT

✦ All PAYMENT IS UPFRONT. The FULL PAYMENT must be paid before I begin.

The FULL PRICE of the Commission + Any Applicable Fees will be notified before payment.

✦ ALL COMMISSION PRICES are based on USD (United States Dollar).

The Client is responsible for making currency conversions.
I am not liable for any mistakes on the Client’s part of the transaction.

✦ ALL PAYMENTS are taken through PAYPAL INVOICE.

Paypal Fees will be covered by me, the Artist.

✦ TIPPING is enabled in Paypal Invoice.

Clients have the choice to send Tips if my service is satisfactory.

✦ After the Slot is processed and confirmed, a PAYPAL INVOICE will be sent via EMAIL.

DO NOT send any payment before the Slot is confirmed and I have sent the Invoice.

✦ DO NOT send any payment through monetary means or as bribes.

✦ Unless discussed with Client, the Paypal Invoice must be paid within 24 Hours after sent.✦ If Payment is not met within the provided time frame, THE COMMISSION IS CANCELED.

Repeated instances of the Client commissioning, yet failing to pay will result in BLACKLISTING.

✦ ONCE PAYMENT IS RECEIVED, I WILL START THE CLIENT’S COMMISSION.

REFUNDS

✦ Clients are entitled to the FULL REFUND, as long as the Commission has not been started.✦ If there are errors in PayPal Fees, Taxes and/or Transfer Fees, only around 80% will be refunded.✦ NO REFUNDS ARE ALLOWED ONCE THE SKETCH HAS STARTED.✦ Once the Commission has started, Clients are entitled to a PARTIAL REFUND.

Dependent on the progress made on the Commission.
Sketch Phase: 75%
Lineart Phase: 40%
Coloring Phase: 20%

✦ If Client has any extenuating situations or concerns, PLEASE DISCUSS WITH ME VIA PRIVATE MESSAGING OR EMAIL AS SOON AS POSSIBLE.✦ If I cancel the Commission, lost fees will be reimbursed and the Client will be 100% Refunded.✦ REFUNDS ARE PROHIBITED FOR COMPLETED WORKS.

CHARGEBACKS

✦ The Client is NOT authorized to issue a CHARGEBACK for ANY REASON.✦ When canceling a Commission Request, the Client is REQUIRED to contact me beforehand.✦ IF FOR ANY REASON, the Client’s PayPal Account malfunctions or authorizes a Refund Request, the Client must contact me AS SOON AS POSSIBLE in order to resolve the issue.✦ ANY UNFAIR CHARGEBACKS, without contacting me to cancel/refund the Commission Request will result in the Client being IMMEDIATELY BLACKLISTED.

This includes BLACKLISTING the Client’s Email Address and PayPal Account.

TURNAROUND PROCESS

✦ Average Wait Time: 3-7 Weeks Per Project

If concerned about the turnaround time, the Client can contact me via Private Messaging or Email.
Please understand that I need more time if there is still a Commission in Queue before yours.

✦ RUSH ORDERS ARE NOT ACCEPTED.

All Commissions must have NO DEADLINES by default.

✦ If the Client has a DEADLINE, this must be disclosed prior to the Payment Transaction.

I may be able, to an extent, prioritize the Commission higher in the Queue to meet the DEADLINE.
If the DEADLINE is shorter than 2 to 3 Months, I WILL NOT ACCEPT.

✦ If a DEADLINE is discussed, the Client is responsible for prompt communication.

I am not held responsible for late delivery due to lack of communication on the Client’s end.
Harassment of my Work Speed is NOT TOLERATED, regardless of the time that has passed.

✦ The Client will be informed if something happens that causes DELAY in their order.

REVISIONS

✦ All Clients are guaranteed to receive a WIP during the Sketch Phase.

ONLY EXCEPTION ARE CLIENTS WHO CHOSE THE SKEB-STYLE ILLUSTRATION.

✦ Please understand that there will be a quality difference between the SKETCH WIP provided to the Client and COMPLETED WORK of the Client’s Commission Request.✦ A maximum of 2 MAJOR REVISIONS during the SKETCH PHASE allowed per Commission.

Only MINOR ADJUSTMENTS within reason can be made afterwards.

✦ Changes will only be made at the SKETCH PHASE.✦ There will be an ADDITIONAL CHARGE for all the following:

Each MAJOR REVISION after the initial 2.
Requesting to revise something in the artwork that was PREVIOUSLY APPROVED by Client.
Request for revisions when the Image Reference provided was UNCLEAR to start with.
Major Revision Request if asked to REDESIGN the outfit for the Character.

✦ REVISION REQUESTS ON COMPLETED WORKS ARE PROHIBITED.

Minor changes such as color adjustments are allowed if the missing or inaccurate mistakes are mine.

FINAL DELIVERY

✦ All CLIENTS RECEIVE THEIR COMMISSION AS A HIGH RESOLUTION PNG FILE.

Provided via EMAIL or GOOGLE DRIVE DL LINK.
If needed and asked upon request, the Client may receive their Commission as a JPG or PDF File.

✦ All CLIENTS are responsible to save and safely keep the DIGITAL FILES I provide.

Depending on the Client’s reasoning of the Commissioned Work being lost and asked upon request:
I will resend the Commissioned Work again via EMAIL or GOOGLE DRIVE DL LINK.

✦ ANY DIGITAL FILE the Client paid for will be available for a FIXED TIME ONLY.

All files are preserved for up to 6 Months (Half a Year).
The preservation may shorten if the following circumstances happen to me:
Sudden Computer Failure/Death
Accidental Deletion or Loss

✦ Please understand that there may be slight differences between the SAMPLES in my Gallery/Portfolio and the COMPLETED WORK the Client receives.✦ The Client must understand and respect that my ‘Artistic Style’ cannot be ALTERED.✦ I RESERVE THE RIGHT to reject any critiques pertaining to Artistic Skill and Stylization, and if the critique reduces the ‘Artistic Quality’ of the Commissioned Work.✦ ANY COMMENTS that are rude, inappropriate, inflammatory, and/or non-constructive criticism when unprompted will result in the Client being BLACKLISTED.
